This legal updates/refresher course will specifically focus on 1st and 2nd Amendment auditors, to include, but not limited to the auditor’s rights and limitations, the officer’s duties and responsibilities, and potential legal remedies.  Background information will be provided for 18 USC 242 and 42 USC 1983, which are the underlying bases of criminal and civil exposure, and the burden that must be met for officers to be held liable under such statutes.  Current case law will be reviewed so that the officers understand the likely outcome of these suits should they arise, and the defenses available to both the officer and the agency.
